The web uploader service (the "Service") is operated and provided to you by Play Sports Network Limited, registered in England with company number 08265494 whose registered office is at 30 Monmouth Street, Bath BA1 2AP (“PSN”, "we", "us”, "our").

Your use of the Service to upload Content of any kind is subject to these Terms of Use. "Content" includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features, social media account name and / or ‘handle’ and other materials you may contribute to the Service.

You must be aged 18 years (or the age of majority in your territory of residence if more than 18 years old) or more to use the Service.

Content which you upload using the Service may be displayed, broadcast or otherwise distributed by PSN and its group companies on any of the platforms, social media and other applications which PSN or its group companies currently operates or may in the future operate, whether owned and operated by PSN, one of its group companies or a third party, including without limitation PSN’s Facebook, Instagram, Twitter and YouTube pages and mobile applications operated by PSN or PSN’s group companies (each a “Platform” and together the “Platforms”).

1. Use of the Content

1. You agree that nothing in these terms or elsewhere guarantees that PSN will broadcast, publish or otherwise use any of the Content you may submit, or creates an obligation on PSN to do so. You acknowledge and agree that PSN has the right to add or withdraw Content from its Platforms at any time, with or without notice.

2. Content

1. You understand that when you submit Content through the Service, PSN does not guarantee any confidentiality with respect to that Content.

2. You retain all of your ownership rights in your Content, but you are required to grant limited licence rights to PSN and its group companies and other users of the Service, as set out in the “Rights You Licence” section of the Terms of Use.

3. You acknowledge that you will not receive financial compensation of any type from PSN or its group companies for your Content. For the avoidance of doubt, no mechanical or other royalties shall be payable to you by PSN or its group companies.

4. You agree that:

1. you will not post or upload any Content containing material which it is unlawful for you to possess in the country in which you are resident, or which it would be unlawful for PSN to possess or use on the Platforms; 

2. you will not post or upload any Content that is defamatory, offensive, inappropriate, otherwise objectionable, infringes the rights of anyone else or is in breach of these Terms of Use; and

3. you will only share Content on the Service that you own or are otherwise authorised to share. Do not post Content which contains third party intellectual property, unless you have the formal right to do so and to grant PSN and its group companies the right to possess and use the Content on the Platforms. This includes, without limitation:

1. Clips of live cycle racing or other events with you have recorded from television;

2. Posting images, logos or any Content which belongs to another and which you do not have permission to use; and

3. Copying images from the internet or from another social profile or platform without the proper permissions.

1. Privacy

1. Any personal information you supply to us or that we collect from you when using the Service will be used by us in the ways set out in our Privacy Notice https://www.playsportsnetwork.com/privacy-notice/eu-en. Please also ensure you read our Cookies and Tracking Technologies Notice https://playsportsnetwork.com/cookies-and-tracking-technologies-notice/.

2. PSN’s Liability to you

1. Your use of the Service is at your own risk. The Service is provided on an “as is” basis. To the maximum extent permitted by law: (a) PSN disclaims all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to the Service; and (b) all implied warranties, terms and conditions relating to the website and/or the website service (whether implied by statute, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non infringement, information accuracy, interoperability, quiet enjoyment and title are, as between https://upload.globalcyclingnetwork.com/ or any related webpages and you, hereby excluded. Your statutory rights are not affected.

2. PSN will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the Service, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.

3. If PSN is liable to you directly or indirectly in relation to the Service, that liability (howsoever arising) shall be limited to (a) fifty pounds sterling (£50.00).

4. Nothing in these terms shall be construed as excluding or limiting the liability of PSN or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by English law.

3. General

1. Except as set out below, the agreement between us and you is personal to you and no third party is entitled to benefit under it. You agree we can transfer, sub-contract and sub-license (as applicable) our rights and obligations under these Terms of Use to any company, firm or person. You may not transfer your rights or obligations under these Terms of Use to anyone else. 

2. You acknowledge and agree that each member of the group of companies of which PSN is a part shall be third party beneficiaries to the Terms of Use and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms of Use which confers a benefit on (or rights in favour of) them. Other than this, no other person or company shall be a third party beneficiary of the Terms of Use.

3. If any provision of these Terms of Use is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms of Use shall not be affected.

4. To the extent we fail to or decide not to exercise any right of claim against you to which we are entitled, this will not constitute a waiver of that right unless otherwise indicated to you in writing.

5. These Terms of Use shall be governed by and construed in accordance with the laws of England and subject to the exclusive jurisdiction of the English courts.
